HOW TO ENTER

Entrants are encouraged to submit their best nature photos taken at Kahalu‘u Bay on Hawai‘i Island. Entrants may enter as many photos as they like each month, but must submit them separately. KBEC shall disqualify any photos that require procurement of a model release for identifiable people, or that contain material or elements that are subject to the rights of third parties.

Entrant must submit his/her photo entry as an attachment to an e-mail with “Kahaluu Bay Photo Contest” as the subject line. The e-mail should include the Entrant’s name, mailing address, e-mail address, and phone number. Send the e-mail to photocontest@kohalacenter.org. All entries become the physical property of The Kohala Center and will not be returned.

PHOTO GUIDELINES
The competition is open to unpublished works created on or after January 1, 2013. Entries must be submitted by e-mail pursuant to the following guidelines:

By entering this contest, Entrant agrees to abide by its rules and to accept the judges’ decision as final. Entrant further acknowledges that his/her entry is his/her own original work. The Kohala Center shall not be held responsible for misrepresentation of Entrants’ submissions, and will comply with any and all requests to remove or cease use of photographs that may have been previously published or are the original property of an entity other than the Entrant.

No purchase or payment is required to win a prize or to participate in this contest.


TERMS AND CONDITIONS

1. CONTEST PERIOD
The contest commences at midnight Hawai‘i Standard Time (HST) on the first day of each month. All entries must be received by 11:59 p.m. HST on the last day of the month in which the Entrant wishes to participate.

2. PRIZES
Each month’s winning Entrant may choose from one of the following prizes:

Retail value of items and shipping will be covered by The Kohala Center. Taxes, if any, are the responsibility of the winner.

3. ELIGIBILITY
Entrants must have reached the age of majority in their country of legal residence at the time of submission to enter the Contest. Legal residents of Cuba, Democratic Republic of the Congo, Iran, Ivory Coast, Libya, Myanmar, North Korea, Republic of the Congo, Somalia, Sudan, Syria, and any country under U.S. embargo are ineligible. Employees of The Kohala Center, its affiliated programs, participating promotional vendors (and their affiliates, subsidiaries, and related companies), and sponsors are ineligible. The contest is open to both amateur and professional photographers. VOID WHERE PROHIBITED BY LAW.

4. USAGE AND OWNERSHIP
Submission of an entry by Entrant and/or acceptance of a prize grants The Kohala Center and its affiliates an irrevocable, non-exclusive, perpetual, worldwide license to publish, use, edit, adapt, modify, excerpt and/or copy the entry in connection with and for the promotion of The Kohala Center and any of its programs, including Kahalu‘u Bay Education Center, in any and all media currently in existence or hereafter developed without further compensation to Entrant, which includes, but is not limited to, the right to publish the entry in The Kohala Center collateral, on kohalacenter.org and its affiliated subdomains (e.g., kahaluubay.org), on its social media properties (e.g., Kahalu‘u Bay Education Center’s Facebook page), and to use Entrant’s photograph as The Kohala Center sees fit in exhibitions and promotions of itself and its programs.

5. JUDGING/WINNERS
Kahalu‘u Bay Education Center staff will judge the entries based on creativity, technical expertise, and aesthetic value. The decision of the judges is final. Judging will occur at 78-6710 Ali‘i Drive, Kailua-Kona, Hawai‘i 96740 on or about the tenth day of the month following the monthly contest period (e.g., judging of entries submitted in July 2013 will be judged on or about August 10, 2103).

Winners will be notified via e-mail or mail on or about the twelfth day of the month following the monthly contest period. Winners will be required to sign and return an affidavit of eligibility, grant of rights to The Kohala Center and its affiliates, a publicity and liability release, and a declaration of ownership in which the Entrant warrants that he or she is the owner of the photograph within seven (7) days of notification, or alternate winners will be selected. By entering this contest and/or accepting a prize, you agree to allow The Kohala Center and its affiliates to use your name, city, and state of residence in connection with publication of your winning entry, and for promotional purposes (as described in Section 3 above) without review, notification, or approval.

6. MISCELLANEOUS
This Contest is subject to all federal, state of  Hawai‘i, and local laws, and is void where prohibited. Winners agree that The Kohala Center and its affiliates and prize contributors, including their parents, subsidiaries, affiliates (and related companies), officers, directors and employees, shall not be liable for injury, loss or damage of any kind resulting directly or indirectly from the Entrant or the Entrant’s guest participating in this contest or from the acceptance or use of any prize awarded, or from use of their names, photos, and/or likenesses for advertising and publicity purposes without further compensation and upon request, will provide written consent to such use (“Release”). The Kohala Center and its affiliates reserve the right to verify eligibility qualifications of any winner(s). The Kohala Center, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Web site, http://kohalacenter.org/kahaluubay/contest.html, or who is otherwise in violation of the Rules. Sponsor further reserves the right to cancel, terminate, or modify the Contest if it is not capable of completion as planned, including but not limited to, for example, infection by a computer virus, bugs, tampering, unauthorized intervention, or technical failures of any sort. In the event of early termination of the Contest, winners will be selected from all eligible entries received at the time of termination in accordance with the judging procedures described above. In no event will The Kohala Center be responsible for any damages or losses arising out of access to and use of the Web site or the downloading from and or printing material downloaded from said site.

The Kohala Center is not responsible for lost, late, incomplete, illegible, or misdirected entries, nor is it responsible for incorrect or inaccurate information utilized in the Contest. Receipt of entries cannot be confirmed. In the event of a dispute concerning the identity of a person submitting an online entry, the entry will be deemed submitted by the person in whose name the e-mail account is registered.

7. GOVERNING LAW: CONSENT TO JURISDICTION
The Contest shall be governed by the laws of the United States as they relate to copyright, and to the laws of the State of Hawai‘i as they relate to all other matters, without regard for choice of laws or conflicts of laws principles.

8. WINNERS LIST
Winners will be notified via e-mail and/or telephone on or about the twelfth day of the month following the monthly contest period. via e-mail. Winners will be announced monthly on Kahalu‘u Bay Education Center’s Facebook (http://www.facebook.com/kahaluubay) and Twitter (http://www.twitter.com/kahaluubay) pages.
